UPDATE - PEQ JUDICIAL REVIEW CASES: Yesterday, lawyers from IMK attended a session at Superior Court with lawyers from the Government of Quebec to deal with technical matters relating to how the PEQ judicial reviews will proceed. Justice Dulude is handling this matter for the Superior Court. The Quebec Government lawyers objected to the cases being grouped and wanted them to proceed individually. In the end, IMK and the Quebec Government lawyer agreed that they would submit a list of issues common to the applications by no later than August 22, 2017. After that, IMK will submit written legal pleadings by September 15 and Quebec Government will have until October 16 to submit its written arguments. Right after that the case will be inscribed for hearing and then a date will be fixed for hearing.
It may happen that the parties arrive at a settlement prior to a hearing. However, rest assured that the position taken by IMK (and supported by Chalk Immigration) is that MIDI must respect its own laws. If there is a settlement offer, all of those in the cases will be informed and allowed to provide their feedback before any settlement is accepted.
Finally, if there are new refusals they will not be grouped with the existing cases but will probably form part of a new group and the decisions on these cases will be put on hold until a decision in the lead cases already submitted.
We have not heard of any new refusals or rejections recently but, if you do receive one, remember that a judicial review application is the only way to ensure that you will benefit from a decision to be made by the Superior Court in the future.
